Supreme Court Sets Argument in Landmark Education Funding Case
The U.S. Supreme Court will hear oral argument in Locke v. Davey on December 2. The Court will decide whether
Washington State violated the Free Exercise Clause by denying a "Promise Scholarship" to a student who majored in
theology at a Christ-centered college.
The CLS Center filed an amicus brief authored by prominent church-state scholars Thomas Berg and Douglas Laycock. The
brief urges the Court to hold that Washington did violate the student's rights.
Center to File Brief in Pledge Case
The CLS Center will file a "friend of the Court" brief in Elk Grove Unified School District v. Newdow, the case
involving the constitutionality of the phrase "under God" in the Pledge of Allegiance. On October 14, the Court
announced that it would review the Ninth Circuit's decision striking down that aspect of the Pledge.
The Center earlier filed a brief urging the Court to take the case.
Child Evangelism Fellowship Awaits Outcome of Appeals
Child Evangelism Fellowship is waiting for two federal appeals courts to decide whether the Constitution permits
public school districts to discriminate against them. Former CLS Center Chief Litigation Counsel Nate Adams presented
oral argument to the U.S. Courts of Appeals for the Third and Fourth Circuits in September. Lower courts had reached
conflicting conclusions about whether such discrimination was permissible. The cases concern school distribution of
informational fliers and permission slips to parents. The CLS Center represents CEF in both cases.
